John A. Ferguson, Jr. will co-present on the topic titled, “Employee Handbook Updates & Must Haves,” at the San Antonio Manufacturing Association’s 16th Annual Employment Law Seminar – Employment Law in 2021: What’s New & What Remains the Same? The seminar will be held on Thursday, February 25 and the presentation will cover the following:
- Top Employee Handbook Updates for 2021 including new employee leave requirements, remote work policies, and health and safety requirements brought about by COVID-19, as well as revised anti-discrimination policies based on the U.S. Supreme Court decision holding that “sex” discrimination under Title VII includes sexual orientation and gender identity.
- The NLRB’s current Boeing test for evaluating the lawfulness of handbook work rules and policies of both unionized and non-unionized employers under the National Labor Relations Act, including examples of language the NLRB has found permissible and language that has been found unlawful, and the consequences of a violation for an overly broad work rule.
