Justin Barbour presented on the topic, “No Fault” Attendance Policies and the ADA: Flexible Leave as a Reasonable Accommodation,” at the SAMA Employment Law Seminar.

His presentation focused on the ins and outs of employers’ obligation to participate in ADAAA’s “Interactive Process” as well as how “Neutral” leave policies may inadvertently violate the ADAAA. Also, Mr. Barbour addressed how employers may owe “Reasonable Accommodation” in the form of flexible leave guidelines and policies and tips for crafting leave policies that protect employer’s interests and enforce effective leave policies while simultaneously respecting employee rights under the ADAAA.
