Justin Barbour and John A. Ferguson, Jr. presented on “Protected Activity” or Grounds for Discharge?: Effectively Handling Employee Complaints,” at the Schmoyer Reinhard Breakfast Briefing held Thursday, April 27th. The speakers discussed the evolving nature of legally “protected activity” and its impact on your employees and workplace. They evaluated the effect of recent NLRB rulings, particularly with regard to handbook provisions, social media, confidentiality, and joint employer issues and discussed what we may expect from a future Trump Board on these issues. They discussed recent OSHA guidance governing accident reporting policies and post-accident drug testing. Finally, they discussed recent EEOC guidance expanding the scope of Title VII’s retaliation protections.
